●What is Exif?

Exchangeable image file format is an image file format developed by Fujifilm and standardized by the Japan Electronic Industry Development Association (JEIDA) that stores image metadata. It is used to save images from digital cameras. It is abbreviated as Exif.

The camera model and information about the shooting conditions are embedded in the image, and can be seen using viewing or photo retouching software. Exif2.2 uses the built-in standard Exif Print to automatically optimize the most accurate condition for printing based on the shooting condition information embedded in the image. Location information is displayed automatically for photos containing GPS data, but not on photos without GPS data.

The uploaded photograph is copyrighted to the posted user. However, EVERYBODY × PHOTOGRAPHER.com agrees to use copyrighted rights non-exclusively from contributors for uploaded photos without charge.

Location information

What can I do if I do not want to display location information?

EVERYBODY × PHOTOGRAPHER.com is basically based on registering location information in all photos, but in order to prevent personal information leaks such as your home address etc., you can have up to 5 addresses you do not want to disclose your location information.

Pictures from areas with a radius of 500 m from the registered address are not disclosed location information, so please use this function by all means. Registration can be done in the Edit Membership page.

How do I search for photos?

EVERYBODY×PHOTOGRAPHER.com offers three main search types: keyword search, spec search, and category search.

For keyword search, you can search for pictures containing keywords in the title / gallery name, category name, or user name of the photo.

In the specification search, it is possible to search with camera maker, focal length, F value, lens manufacturer. In category search, you can search the photo list registered in the selected category.

■Article 1　Definition of Terms

Ltd (hereafter, "the Company" or "we"), for the purpose of allowing users of EVERYBODYxPHOTOGRAPHER.com (hereafter, "the Customer" or "you") to submit images to this site, establishes the following agreement (hereafter, "this Agreement" or "these Terms") to be applicable to the Customer.

２．The words used in this Agreement shall be defined as follows:

１．The service provided by the Company to the Customer of providing the functions of the sharing of photographs utilizing cartographic information via EVERYBODYxPHOTOGRAPHER.com and all other related functions shall be termed "this Service".

２．When the Customer, by clicking buttons placed on EVERYBODYxPHOTOGRAPHER.com, duplicates and saves a photo on the site's server, this act shall be termed "submission".

■Article 2 Account

1.To use this Service, you must register for an EVERYBODYxPHOTOGRAPHER.com account (hereafter, "Account"). Syuppin Members may log in easily using the existing ID and password that were registered with their Membership.

2. For the necessity of system cooperation relating to Syuppin point giving program and so forth, except Syuppin members who register with this site, excluding registering from a social networking service such as Facebook, Google+ or Twitter, shall be deemed to have agreed with our terms of service and to have been registered with Syuppin membership.

3．You may have one Account at EVERYBODY×PHOTOGRAPHER.com per email address. Furthermore, one Customer may register one Account.

4．If you lose possession of the email address with which you registered, we ask you to quickly update your registration email address.

■Article 3　Provision of a Use Environment for this Service

1.To use this Service, the Customer must be able to access the Web.

Furthermore, the Customer must appropriately provide and operate all devices and software needed for accessing the Web and be personally responsible for the costs necessary in doing so. This Company shall have no participation whatsoever in any provisions needed or methods by which the Customer accesses the Web.

２．The Customer agrees to take measures against the transmission of computer viruses, unauthorized access, and unauthorized disclosure of information in the Customer's own use environment. The Company assumes no responsibility for any damages incurred by the Customer such as the failure of their use environment caused by use of this Service.

■Article 4　Customer's Responsibility Concerning Submitted Images and GPS Data

１．All responsibilities concerning the Customer's images and GPS data submitted to EVERYBODYxPHOTOGRAPHER.com shall be assumed by the Customer who submitted the images and data. Accordingly, the Customer shall note that, in the event any third party incurs damages related to the Customer's submission of images or GPS data, this Company shall take no responsibility on behalf of the Customer.

２．The Customer shall take due care in ensuring that they possess all relevant copyrights, including but not limited to the right to reproduce, the right to publicly display, the right to transfer, the right to translate, and the right to adapt, to the images they submit and shall furthermore guarantee to us that they possess these rights. In situations that fall under the following categories in particular, the Customer shall take due care to submit images only after carrying out necessary procedures.

1. When submitting images that use the intellectual property of third parties:

Your submission of said images is premised on your handling of all necessary procedures concerning rights and consent as described in Article 5 Paragraph 1. This includes all procedures necessary for this Company to obtain consent for usage rights from you and procedures necessary for a third party to obtain reuse rights from this company. You must use due care when submitting images that utilize the works of third parties to our Service.

2.When submitting images depicting persons:

Sharing photographs or GPS data of individuals without the consent of any and all depicted individuals may be an infringement of their privacy or rights to the use of their likeness. You must obtain permission from all individuals appearing in your photographs to take or submit them to our Service.

3.When submitting images depicting places or objects of which photography has been forbidden:

You must obtain permission from any and all relevant authorities both to take and submit photographs of locations or objects for which photography restrictions (including both explicit and implicit limitations) exist.

■Article 5　Image Rights

1.Upon submitting a photograph to EVERYBODYxPHOTOGRAPHER.com, the Customer consents to this Company's usage of said photograph under all relevant domestic and international copyrights, including but not limited to the right to reproduce, the right to publicly transmit, the right to transfer, the right to translate, the right to adapt, and the right to create derivative works of said photograph, at no charge and until the effective period of these rights shall end. Furthermore, the Customer consents to the continuation of our holding of these rights to the said image even should the Customer withdraw their membership from this Service.

２．The Company shall not delete submitted images from the Service even at the Customer's request. The Customer may delete their own submitted images using the "My Page" provided to each Customer.

３．Images submitted by the Customer shall not be automatically deleted from the Service even should the Customer withdraw their membership from this Service. If you do not wish for your images to continue to appear on this Service after you withdraw your membership, you must delete these images or set them as private before withdrawing your membership.

■Article 6　Function for Submission of Photos to External Services

This Company, in order to allow other Customers share the pages upon which submitted images appear with unspecified large numbers of third-party users (hereafter, "User(s) of Affiliated Services"), has placed buttons on each of the said pages (hereafter, "Submission Button") to allow Customers to submit the page to Social Networking Services (hereafter, "Affiliated Services") operated by Facebook, Google+, Twitter, LINE, and others (hereafter collectively referred to as "Operators of Affiliated Services"). As a result of pressing the Submission Button and depending on the operation of the Affiliated Service, there may be situations in which the page of the submitted image and its attendant rights (including the reuse rights allotted to third parties by the Operators of Affiliated Services) shall be used by third parties. The Customer consents in advance to this usage of their rights.

■Article 7　Prohibited Conduct

１．The following behaviors are prohibited during the use of the Service.

１．Saving information (whether in whole or in part) posted or displayed on EVERYBODY×PHOTOGRAPHER.com by reproduction or any other means without advance permission from this Company, except as permitted under the law, this Agreement, or the Guidelines, for the purpose of viewing, reproducing, transmitting, transferring, distributing, reselling, or altering said information.

２．Behavior that violates these Terms or the Guidelines.

３．The submission of obscene or adult-only images.

４．Behavior related to criminal activities.

５．Soliciting for personal business or trade.

６．Abusive or slanderous behavior towards other individuals.

７．The submission of images generally accepted by society as being violent or images that could be perceived as such.

８．Impersonating a third party by the posting of false information.

９．Behavior which infringes upon the intellectual property rights (including but not limited to copyrights, design rights, utility model rights, trademark rights, patent rights, or know-how), the reputation, or the privacy, or any other rights or privileges of this Company, other Customers, or any third party, or any behavior which may infringe upon those rights and privileges.

10．Behavior which disseminates specific political or religious opinions or GPS data the use of which may give the impression of specific political or religious opinions to any third party.

11．All behavior which would cause disadvantage to other Customers or third parties.

12．Behavior which would obstruct this Company's operations or damage this Company's trustworthiness.

13．Behavior inconsistent with public order and morals.

14．All other behavior judged improper by this Company.

■Article 8　Measures against Infringing Conduct, etc.

１．This Company reserves the right to delete or make private any images etc. under the following circumstances, regardless of whether the images or information are illegal or in violation of this Agreement or not. This shall be referred to hereafter as "Deletion Measures".

1．If we judge that an image you have submitted falls under any of the conditions listed above.

2．If any public institution or expert (e.g. any national or local public entity, any trusted organization designated under legal guidelines as concerning the disclosure of information by originators or concerning the limitations of responsibility for damages by specific telecommunications providers, any internet hotline, any lawyers) expresses or indicates that the submitted image or information infringes upon the rights of others, is illegal, or transgresses public order or morals.

3．If we determine that the content of an image you have submitted violates the copyright of a third party.

4．In any other situation where the Company determines that it is necessary to take Deletion Measures.

２．In the event that the Company determines the Customer to fall under any of the preceding situations or in other situations as determined by the Company to be necessary, the Company reserves the right to take such measures as suspension of the Customer's account (hereafter, "Account Suspension Measures") in addition to Deletion Measures.

３.The Customer agrees not to object to or protest either Deletion Measures or Account Suspension Measures taken by this Company.

■Article 9　This Company's Indemnity

1.This Company makes no guarantee of the reliability of the storage of images submitted by the Customer to EVERYBODYxPHOTOGRAPHER.com. You agree to take measures against the loss of any images submitted to EVERYBODYxPHOTOGRAPHER.com by backing them up on your own computer.

２.This Company accepts no responsibility for the resolution of disputes or troubles between you and another Customer caused by submitted images or for any other reason. You agree to resolve all such disputes on your own.

３.This Company reserves the right to alter, suspend, or terminate this Service at any time without advance notice to the Customer should the Company deem it necessary. This Company shall accept no responsibility for any damages caused by the alteration etc. of the Service in that event. This condition shall apply to any dysfunction in service or decline in displayed speed or other issue caused by excessive traffic or any other unforeseeable cause.

4.This Company accepts no responsibility for any trouble arising from private information being made public through posting to this Service, as all images and GPS data posted are assumed to have been made public by the Customer's free intentions.

5．This Company accepts no responsibility for any damages incurred by the Customer arising from Deletion Measures or Account Suspension Measures taken by this Company for violations of these Terms or other conditions of use or on reasonable suspicion of such violations.

■Article 10　Provision of Information

1．This Company may contact the Customer by the email address used during their registration with information and notices concerning this service as well as e-commerce sites operated by this Company. You agree in advance to receive these messages.

2．This Company may contact the Customer by the email address used during their registration if there are any important notices to be issued. The Company accepts no responsibility for any damages incurred in viewing these email notices.

■Article 11　Privacy

1.The handling of privacy by this Service is described in the Syuppin Site Personal Information Policy.

■Article 12　Changes to this Agreement

The terms of this Agreement for the use of EVERYBODYxPHOTOGRAPHER.com may be changed as necessary without advance notice. Once any altered version of this Agreement is displayed on EVERYBODYxPHOTOGRAPHER.com, it shall come into effect immediately.

■Article 13　Applicable Law

This Agreement shall be interpreted based on the laws of Japan.

■Article 14　Agreed Jurisdiction

In the event that litigation between the Customer and the Company becomes necessary, the Tokyo Summary Court or the Tokyo District Court shall be the exclusive court of jurisdiction for the first trial.
